Terms of Service

1. The agreement

These terms are an agreement between you and who.is (“we”, “us”), which operates Hooky at hooky.email, app.hooky.email, and the Hooky API (“Hooky”). If you use Hooky for a business, you agree for that business, and “you” means the business. By using Hooky you confirm that you are at least 18 and can make this agreement.

Our Privacy Policy is part of these terms.

2. What Hooky does

Hooky receives email that you forward to it. For each message, it chooses one of the actions you set up, runs that action, and records what it did and why. Actions can send replies, forward email, call your webhooks, hold messages for you, or ignore them.

3. Your account

• You sign in with links that we send to your email address. Keep that mailbox secure. Anyone who can read it can sign in as you.
• You are responsible for the members you invite and for everything done in your workspace, including with your API keys.
• Tell us at once if you think someone used your account without permission.

4. Your actions and the email Hooky sends

You control what Hooky can do. You choose the actions, their instructions, their webhooks, whether they wait for approval, and their daily limits. You are responsible for:

• The results of the actions you set up, including refunds, cancellations, and other changes that your webhooks make.
• The replies and forwards that Hooky sends for you, as if you sent them yourself.
• Your right to forward the email you send to Hooky, and to have it processed as these terms describe. This includes any notice or consent that the law requires you to give the people who write to you.
• The security of your webhook endpoints. Check the signature on each call as our documentation describes.

5. AI output

Hooky uses AI models to read email, choose actions, fill in details, and write replies. AI output can be wrong, incomplete, or unsuitable, even when Hooky reports high confidence. You agree that:

• You will review Hooky’s decisions and use approval for any action where a mistake would cause harm, such as sending money or changing an order.
• Hooky’s output is not legal, financial, medical, or other professional advice.
• We are not responsible for loss that results from AI output that you allowed to run without approval.

6. Acceptable use

Do not use Hooky to:

• Send spam, bulk or marketing email, or any email that breaks CAN-SPAM or similar laws. Hooky is for replies to people who wrote to you.
• Receive or process email that you have no right to receive or process.
• Commit fraud or phishing, pretend to be another person or business, or break any law.
• Harass, threaten, or harm anyone, or send malware.
• Process health records, payment card numbers, or other data that needs HIPAA, PCI DSS, or similar protections.
• Get around limits or security controls, probe or overload Hooky, or reach other customers’ data.
• Copy, resell, or rebuild Hooky, or use it to build a competing service.

If your use causes a high rate of bounces or complaints, or puts our sending reputation at risk, we can pause your sending while we look into it.

7. Limits

Hooky has daily limits on messages, actions, replies, and AI use. When you reach a limit, new email waits in your console. It is not dropped. We can change limits to protect the service, and we will show the current limits in the console.

8. Fees

Hooky is free during early access. We may start charging later. If we do, we will email your workspace members and publish the prices at least 30 days before any charge. You can stop using Hooky before then. Paid use will need your agreement to the prices.

9. Your data

You own your data, including the email you forward and your action settings. You give us permission to store, process, and send it only as needed to provide Hooky, to keep it secure, and as the Privacy Policy describes. We do not use your data to train AI models.

Hooky deletes messages and logs after 90 days. It is not an archive. Keep your own copy of anything you need to keep.

10. Feedback

If you send us ideas or feedback, we can use them without any duty to you.

11. Suspension and ending

You can stop using Hooky at any time. Remove the forwarding rule and delete your workspace in the console.

We can suspend or end your access if you break these terms, if your use puts Hooky or other people at risk, or if the law requires it. When we can, we will tell you first and give you a chance to fix the problem. We can also stop offering Hooky. If we do, we will give you at least 30 days’ notice.

Sections 4, 5, 9, 12, 13, 14, and 16 continue after this agreement ends.

12. Disclaimer

HOOKY IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT HOOKY WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL ROUTE EVERY MESSAGE CORRECTLY, OR THAT EVERY EMAIL IT SENDS WILL BE DELIVERED.

13. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT HOOKY IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR HOOKY IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US $100.

Some places do not allow these limits. In those places, our liability is limited to the smallest amount the law allows.

14. Indemnity

You will defend and pay for claims against us, and related costs and reasonable legal fees, that arise from your data, the actions you set up, the email Hooky sends for you, or your breach of these terms.

15. Changes to these terms

We may update these terms. We will change the date at the top. If a change is important, we will email your workspace members at least 14 days before it takes effect. If you keep using Hooky after that, you accept the new terms.

16. Law and disputes

The laws of the State of Colorado, USA, govern these terms, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts in the City and County of Denver, Colorado, and you and we agree to their jurisdiction.

17. Other terms

• These terms and the Privacy Policy are the whole agreement about Hooky.
• If a court finds part of these terms unenforceable, the rest stays in effect.
• If we do not enforce a term, we do not give up the right to enforce it later.
• You cannot transfer this agreement without our written consent. We can transfer it as part of a sale or reorganization of our business.
• We send notices to the email addresses of your workspace members.
